Yesterday the Kyiv City Commercial Appeals Court held a hearing of an appeal claim filed in case 35/465 for the recovery of $45.2 million from the Ukraina department store. The evidence used in the case is a series of debt agreements entered into by Lyndhurst Development Trading S.A., signed with the forged signature of the director/owner Peter Darragh Quinn – a fact he has confirmed under oath. The panel of judges has denied the authorized representative appointed by Ukraina Acting Director Rostislav Levinzon the right to represent the shopping mall and rescheduled the further hearing of the case to February 9.

After numerous significant breaches of the norms of procedural law during legal proceedings and unfounded remedial orders, the majority shareholder of the shopping mall "Ukraina", the Swedish company Quinn Holdings Sweden AB (QHS) has filed complaints to the Highest Qualification Commission for Judges of Ukraine, requesting the opening of disciplinary investigations with respect to certain judges of Kyiv City Commercial Court.

Today the official representative of the Irish state-owned bank IBRC Richard Woodhouse made an official statement with respect to the ruling of the judge of the Kyiv City Commercial Court Maria Litvinova, who satisfied the claim of Lyndhurst Development Trading S.A. company against the shopping mall "Ukraina" for the payment of 45.2 mln US dollars. He called it legalized robbery and said he had never encountered such a cynical deprivation of property.

Last night the Kyiv City Commercial Court held a hearing in the case No. 35/465 filed by the company Lyndhurst Development Trading S.A. against the shopping mall "Ukraina" for the payment of 45.2 million U.S. dollars. The lawyers of state-owned bank IBRC are convinced that this might be the first step towards the premeditated bankruptcy of the Mall. On the same day, the Kyiv City Commercial Court deliberated three other cases involving the shopping mall "Ukraina."
